A landmark decision of the Italian Constitutional Court: granting preference to free software is lawful

Just over a year ago, the Piedmont Regional Council passed a law which states: "... the Region, in the process of choosing computer programs to acquire, prefers free software and programs whose source code can be inspected by the licensee" (Article 6, paragraph 2).

This choice was welcomed with enthusiasm by Free Software supporters and civil society, while the Presidency of the Italian Council of Minister contested this law, by referring to the Constitutional Court in order to declare it unlawful.

UK: The Open Source, Open Standards and Reuse Strategy

‘Open Source’ has been one of the most significant cultural developments in ICT over the last two decades.  Products that provide access to the source code that powers the application enables the wider development community to exploit new and innovative solutions to business requirements.  These products are based on open standards and can thus be re-used to solve multiple problems and can be repurposed quickly. 

Traditionally, the public sector has relied on Commercial Off-The-Shelf (COTS) software or bespoke solutions from global providers. This restricts the ability of the public sector to reuse solutions, reduces flexibility to manage assets efficiently and prevents government organisations from switching suppliers. The Open Source, Open Standards, Reuse strategy provides guides on how to use Open Source alternatives that meet public sector requirements. Government already commits to using only open standards for documentation. The ICT strategy will build capability within the public sector to increase the amount of open source code and software in use and make it available for reuse elsewhere.

UK Government policy update supports open source

The UK government has published an updated policy on open source in government. The new policy takes a more aggressive position on government use of open source than the original policy, published in 2004. That document set out five policy points that allowed open source based solutions to be considered alongside proprietary solutions and tried to avoid lock in to proprietary software. The new policy document notes how the 2004 policy has already had effects, such as 50 per cent use of Apache web server within departmental web sites, and the NHS "Spine" migration to a Linux based infrastructure, which will cover 35 per cent of NHS organisations.

British Library Launches UK Web Archive

The public domain, as we understand it, is the wealth of information that is free from the barriers to access or reuse usually associated with copyright protection, either because it is free from any copyright protection or because the right holders have decided to remove these barriers. It is the basis of our self-understanding as expressed by our shared knowledge and culture. It is the raw material from which new knowledge is derived and new cultural works are created. The Public Domain acts as a protective mechanism that ensures that this raw material is available at its cost of reproduction - close to zero - and that all members of society can build upon it. Having a healthy and thriving Public Domain is essential to the social and economic well-being of our societies. The Public Domain plays a capital role in the fields of education, science, cultural heritage and public sector information. A healthy and thriving Public Domain is one of the prerequisites for ensuring that the principles of Article 27 (1) of the Universal Declaration of Human Rights ('Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits.') can be enjoyed by everyone around the world.

The digital networked information society has brought the issue of the Public Domain to the foreground of copyright discussions. In order to preserve and strengthen the Public Domain we need a robust and up-to-date understanding of the nature and role of this essential resource. This Public Domain Manifesto defines the Public Domain and outlines the necessary principles and guidelines for a healthy Public Domain at the beginning of the 21st century. The Public Domain is considered here in its relation to copyright law, to the exclusion of other intellectual property rights (like patents and trademarks), and where  copyright law is to be understood in its broadest sense to include economic and moral rights under copyright and related rights (inclusive of neighboring rights and database rights). In the remainder of this document copyright is therefore used as a catch-all term for these rights. Moreover, the term 'works' includes all subject-matter protected by copyright so defined, thus including databases, performances and recordings. Likewise, the term 'authors' includes photographers, producers, broadcasters, painters and performers.

What the Open Government Directive Means for Open Source?

On the heels of the Open Government Memo of January 21st, 2009, the Obama Administration has issued the Open Government Directive. The Directive tells agencies what they must do to meet the expectations set by the Memo. The directive names many deadlines for agency compliance, most of them around reducing FOIA backlogs and increasing the amount of agency data released to the public. This isn’t surprising, since the Memo names transparency, collaboration, and participation as the guiding principles. Transparency is the easiest to articulate and implement — just get the data out there in a useful form. Josh Tauberer’s Open Data is Civic Capital: Best Practices for “Open Government Data” is an excellent handbook for doing this. If you want to track agencies’ progress, the Sunlight Labs folks have produced the outstanding Open Watcher.
What’s most interesting to me, and my friends at Open Source for America, though, are the more ambiguous orders. Although the Directive does not use the phrase ‘open source software’ at all, many of the principles and methodologies described are obvious references to open source. Many of these orders stand out as opportunities for open source developers, in the public and private sector, to demonstrate how our development model can help the Administration also make good on the last two principles: collaboration and participation. As Macon Phillips, the White House New Media Director said, “Open Source is… the best form of civic participation.”

Malaysia: 95 % OSS

Some 95 percent of Malaysia's government agencies have adopted open source software (OSS), but the remaining 5 percent have not warmed to the concept--and is unlikely to anytime soon, according to a government official.

Denmark changed to ODF and OSS

It has been announced by the Danish government, that the Danish state administrative body will adopt the open format ODF as its sole document standard from April next year. This means that the Danish state will now ditch Microsoft’s proprietary document formats.

San Francisco’s official open source policy

The city of San Francisco has made public it’s open source policy for software purchases. In a blog post by the city’s mayor, the new policy requires that the city equally consider open source software while making software purchases.

The highlight of the post was the realization that new and innovative technologies have been created with open source technologies when the government released all its data in open and machine readable formats.
One of the most interesting new applications has been the city government’s integration with Twitter and how it is leading the city government to receive reports about broken civic amenities and fix these problems in realtime.

USA: Proposed Guidelines For Open Government Plans

Open Source for America (OSFA) represents more than 1,500 businesses, associations, non-governmental organizations, communities, and academic/research institutions who have come together to support and guide federal efforts to make the U.S. Government more open through the use of free and open source software. We applaud the Obama Administration’s Open Government Initiative and the December 8th Directive requiring all federal agencies to promulgate Open Government Plans. We offer the following recommendations for essential elements that belong in every Open Government Plan:

Január 13-án adták át a Microsoft Korlátlan Lehetőségek programja keretében meghirdetett pályázat nyerteseinek megítélt pénzbeli támogatást. A tavaly benyújtott magyarországi pályamunkák közül a nemzetközi bírálóbizottság az Internet Terjesztéséért Alapítvány és a Bács-Kiskun Megyei Civil Szolgáltató Központ közös pályázatát értékelte legjobbnak. A díjazottak az elmúlt évben már átadott, közel 41 ezer dollár értékű szoftveradomány után ezúttal 11 960 dollár értékű szoftvercsomagot és 50 ezer dollár pénzbeli támogatást vehettek át, amellyel az alapítvány, illetve a civil központ digitális írástudás elsajátítását célzó felzárkóztató projektjeinek megvalósítását segíti a Microsoft. Report Says Open Source Code Grows More Secure

Open Source Promoted in New California Policy

California has officially accepted open source software (OSS) as a viable option for state government, and while the move won't exactly deliver the state from its multibillion dollar deficit, departments will have access to free software, which could save a few million dollars, said state Chief Deputy CIO Adrian Farley.
In the official letter issued Jan. 7 from the state CIO's office, the policy establishes the use of OSS in California state government as an "acceptable practice." Farley doesn't know of any other states with similar OSS policies, but he said it's consistent with policies done by the U.S. Department of Defense and the UK government.

Nyílt forráskód: Magyarország a középmezőnyben

A Red Hat és a Georgia Technológiai Intézet nyilvánosságra hozta a Nyílt Forráskód Index (Open Source Index) elnevezésű közös tanulmányukat, amely a világ 75 országának nyílt forráskóddal kapcsolatos tevékenységét és a nyílt forráskód elterjedésének lehetőségét vizsgálta.
